Actually it is against the law to disturb, move, or destroy the active nest of a wild native bird. Not much you can do, it is not like the bird is going to hurt you. You will likely cause it to abandon the nest due to too much disturbance, or the bird will just deal with it. The nest will not be there forever, eggs will hatch within a couple weeks and chicks will leave nest in a couple weeks (dependent on species) and than you will not have to worry about it anymore. If you can, try to avoid getting too close to the nest.
